1. About these terms

This website, allclearcare.com, is operated by Warrenpeace Solutions LLC, doing business as All Clear Care ("All Clear Care," "we," "us," or "our"). These Terms of Service apply to your use of our website and purchases from our store, together with the policies linked below and any separate terms you expressly agree to for a particular transaction.

Please read these terms before using our website or placing an order. By using the website or placing an order, you agree to the applicable terms. If you do not agree, please do not use the website or place an order. Nothing in these terms removes rights or remedies that cannot lawfully be excluded.

2. Eligibility and account information

To place an order, you must be legally able to enter into a binding contract. If purchasing for an organization, you represent that you have authority to act on its behalf.

Provide accurate contact, billing and delivery information, and keep your account information current. Protect your account credentials and contact us promptly if you suspect unauthorized account use. Do not submit payment-card details or account passwords through contact forms, email or chat.

3. Products, prices and promotions

Product availability, pack sizes, quantities and current prices are shown on the relevant product pages. Prices are in US dollars unless expressly stated otherwise. Applicable taxes and shipping charges are displayed during checkout before purchase.

We work to describe our products accurately. Images may differ in appearance across devices, and packaging may change. We will not substitute a materially different product without your agreement. Product use and disposal directions are provided on the packaging and relevant product pages.

Prices and promotions may change for future purchases. Discount codes and offers are subject to their stated eligibility, limits and expiration dates. We will not add charges to an existing order without your agreement.

4. Orders and payment

Orders are subject to availability, successful payment authorization and reasonable checks for fraud, order errors and delivery eligibility. An automated acknowledgment confirms receipt of your order and does not guarantee availability.

We may decline or cancel an order for a legitimate reason, such as unavailable inventory, suspected fraud, an unsupported destination or a material pricing error. We will notify you using your supplied contact information and promptly refund any payment collected for canceled items, including applicable taxes and shipping charges. If a correction would change your order or increase its price, we will seek your agreement before proceeding.

We do not prohibit business or resale purchases merely because the buyer is a retailer, distributor or other business. Larger-volume and negotiated wholesale orders are addressed below.

5. Shipping, fulfillment and larger orders

Our Shipping Policy describes standard shipping destinations, charges and delivery estimates. Standard website shipping serves the contiguous 48 United States and Washington, DC, excluding Alaska, Hawaii and US territories.

Orders over 160 lb require a shipping quote before checkout. Contact customer.service@allclearcare.com with your product pack sizes, quantities and delivery city, state and ZIP code. A quote request does not place an order or authorize payment.

We use Amazon Multi-Channel Fulfillment for website orders. Amazon or delivery carriers may perform fulfillment and delivery, but All Clear Care remains your point of contact for standard website purchase issues.

Delivery estimates are not guarantees unless expressly identified as guaranteed. If we cannot ship within the applicable promised period, we will provide any delay notice, cancellation option and refund required by law. These terms do not waive your rights relating to delayed, lost, missing or undelivered orders. Contact us promptly if your delivery has a problem.

6. Cancellations, returns and refunds

Our Returns and Refunds Policy governs return eligibility, return shipping, damaged or incorrect products, exchanges and refunds. Please review it before purchasing.

Contact us as soon as possible to request cancellation. Orders can enter fulfillment quickly, so we cannot guarantee cancellation once fulfillment has started. This operational limitation does not restrict cancellation or refund rights provided by applicable law.

7. Buy with Prime and other purchase channels

Where Buy with Prime is offered, Amazon determines membership eligibility and displays applicable delivery and return benefits through the purchase flow. Use the order-management or return instructions supplied with your Buy with Prime order, or contact us for assistance.

Applicable Buy with Prime benefits and Amazon return procedures are not restricted by the standard website return conditions in our policies. Buying through standard website checkout does not require Prime membership and uses the shipping options displayed there.

Purchases made directly through Amazon, Walmart or another marketplace are also subject to that marketplace's applicable purchase and return processes. Please use the order-support tools for the channel where you purchased, or contact us for help identifying the correct process.

8. Bulk, wholesale and commercial purchasing

Businesses may purchase available case packs at the prices displayed through standard website checkout. Purchasing a case does not automatically establish a wholesale account, credit terms, exclusivity or special pricing.

For negotiated wholesale or recurring commercial orders, we will confirm applicable products, quantities, pricing, shipping, payment requirements and any separate return or cancellation terms in writing before purchase. A quote is subject to the validity period and conditions stated in it. Credit terms, resale authorization or exclusivity apply only when expressly agreed in writing.

A separately agreed commercial contract controls over these website terms to the extent of a specific conflict for the transaction it covers, subject to applicable law. Submitting a wholesale inquiry does not commit either party to an order.

9. Privacy and Shopify

Our Privacy Policy describes how personal information is collected, used and disclosed. It controls over these terms for questions concerning personal-information processing.

Shopify hosts our store and processes information when you visit or make purchases. We also use Shopify enhanced services that may incorporate information from interactions with our store, other merchants and Shopify. Information may be shared with Shopify and service providers in other countries to provide these services. You can access Your Privacy Choices to submit applicable data-sharing and targeted-advertising opt-out choices.

10. Reviews, submissions and private inquiries

You retain ownership of content you submit. If you submit a review for public display through a review feature, you grant us a non-exclusive permission to display it with the reviewer name you choose and make formatting changes that do not distort its meaning. We will seek your permission before using private communications as testimonials or using submitted content beyond the permission you gave.

Private support messages, chat conversations and wholesale inquiries are not public review submissions. We use and disclose personal information in these communications as described in our Privacy Policy, including as needed to respond and provide services.

Reviews must reflect actual experiences. Do not submit impersonations, unlawful content, confidential information belonging to someone else, or material that infringes another person's rights. We may moderate spam, irrelevant material and unlawful or otherwise inappropriate submissions. We do not prohibit or penalize honest negative reviews or remove a review merely because it is negative.

11. Website content and acceptable use

Our branding, original website content and other protected materials belong to us or our licensors. You may use the website for lawful shopping, product research and business inquiries. Buying products does not grant rights to our trademarks or marketing materials beyond rights separately granted or provided by law.

Do not use the website for fraud, harassment, impersonation, unauthorized collection of personal information, infringement, distribution of malicious software or interference with website security or operation. We may restrict access reasonably necessary to address unlawful use, security threats or a material violation of these terms, subject to applicable law.

12. Third-party services and links

Payment, fulfillment, account and other third-party services may have their own terms and privacy notices. Review the terms presented when you choose to use those services. Links to external websites do not make their content ours. These provisions do not remove obligations we have to you as the seller of your order.

13. Website availability and responsibility

We take reasonable steps to keep our website accurate and available, but do not promise uninterrupted access or an error-free website. We may maintain, update or temporarily suspend website features. An interruption does not eliminate obligations relating to an existing order.

To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising from use of the website, such as loss of business profits, except where liability cannot lawfully be excluded. No provision excludes liability for fraud, willful misconduct, gross negligence, personal injury or product-related liability to the extent such liability cannot lawfully be excluded. Nothing disclaims a product description, express promise, applicable warranty or consumer remedy that cannot legally be disclaimed.

14. Governing law and disputes

These terms are governed by Arizona law and applicable United States federal law, without overriding mandatory consumer protections or rights to bring a claim in a forum available under applicable law. If a concern arises, please contact us so we can try to resolve it. Contacting us is not a prerequisite to exercising a right that cannot lawfully be restricted.

15. Changes, interpretation and other provisions

We may update these terms for future use of the website and future purchases. We will post the updated terms and revision date and provide additional notice where required. Changes do not retroactively alter an existing order or separately agreed contract without your agreement, except as required by law.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Our failure to enforce a provision on one occasion does not waive our right to enforce it later. These terms, incorporated policies and any separately agreed transaction terms form the agreement for their respective subject matter and do not exclude rights or representations that cannot lawfully be excluded.
